A 13-year old boy was allegedly assaulted at the Mineral County Fair this past weekend for not removing his hat during the national anthem, according to KTVQ.

The Missoulian reports 39-year old Curt James Brockway of Superior was arrested after one witness heard a "pop" and then saw a boy laying on the ground bleeding from the ears. Another witness said Brockway justified the assault and had "every right to do that" because the boy had been "disrespecting the national anthem."

Brockway remained in jail as of 5pm Monday (8/5) with the state asking for a $100,000 bond, but the judge ruled he can be released on his own recognizance.

According to the Missoulian, Brockway is currently serving a 10-year probation sentence following an assault with a weapon charge and is registered as a violent offender.

The 13-year old boy has been released from the hospital and is back home, reports KTVQ.
