MSC Overrules Fox
The Montana Supreme Court has overruled an opinion by Attorney General Tim Fox over the Bullock administration’s approval of conservation easements. Q2 reports the Fish, Wildlife and Parks Department negotiated the proposed easement, but the land board voted three-to-two delay the action, which concerned a 15,000-acre easement east of Glendive. However, Montana Gov. Steve Bullock went forward, arguing conservation easements don’t need to be approved by the land board because they are not a direct acquisition of land. On Tuesday, the state’s highest court overturned AG Fox’s decision.
